Terms of Service

By accessing or using wardensystems.ai (the "Site"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site.

The Site provides information about Warden Systems LLC ("we," "us") and our products, and accepts inbound contact from prospective customers. Use of any Warden Systems product (HearthWarden, Wizard, Ridgefield Main Street, CivicWarden, or any other) is governed by that product's own license or terms, which apply separately from these Terms.

We grant you a limited, non-exclusive, revocable license to access and use the Site for personal or business purposes consistent with these Terms. You may not:

• attempt to gain unauthorized access to any part of the Site, our infrastructure, or any account;
• scrape, crawl, or harvest content at a rate or in a manner that degrades service for other users;
• bypass or attempt to bypass any access control, rate limit, or security measure;
• impersonate Warden Systems, its representatives, or any other person;
• use the Site to send unsolicited commercial communications, malicious code, or harmful content;
• reverse-engineer, decompile, or attempt to extract source code from any Site asset except as expressly permitted by law.

The Site and its content — including the Warden Systems name, the "guardian software" tagline, product names (HearthWarden, Wizard, Ridgefield Main Street, CivicWarden), logos, copy, design, code, and graphics — are owned by Warden Systems LLC or our licensors and are protected by United States and international intellectual-property law. We grant you no rights in our marks or content except the limited license in §3.

If you send us a message, idea, suggestion, or other content through the Site, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use that content for our business purposes. We will treat your personal information consistent with the Privacy Policy. Do not send us anything you consider confidential through an unsolicited contact-form submission.

The Site may link to third-party sites or services. We do not control and are not responsible for the content, privacy practices, or availability of any third-party site.

The Site is provided "as is" and "as available," without warranty of any kind, express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free from harmful components.

To the fullest extent permitted by applicable law, in no event shall Warden Systems LLC, its members, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including lost profits, lost data, or business interruption) arising from or related to your use of the Site, whether in contract, tort, or otherwise, even if we have been advised of the possibility of such damages. Our total aggregate liability arising from or related to the Site shall not exceed one hundred United States dollars.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions our liability is limited to the maximum extent permitted by law.

You agree to indemnify and hold harmless Warden Systems LLC and its representatives from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site.

We may suspend or terminate your access to the Site at any time, for any reason, including violation of these Terms. The provisions of §4, §5, §7–§9, §11, and §12 survive termination.

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Clark County, Washington, and you consent to the personal jurisdiction of those courts.

We may revise these Terms from time to time. Material changes will be announced with a revised effective date at the top of this page. Continued use of the Site after a change constitutes acceptance.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Warden Systems LLC regarding the Site. If any provision is held unenforceable, the remaining provisions remain in effect.
